Suit against local employer dropped

A former Emerson Climate Technologies employee who claimed he was discriminated against and wrongfully fired has dropped one of his lawsuits against the local manufacturer.
On Tuesday, Phil Berger, 59, of Lebanon, filed a notice of dismissal in the lawsuit, which was being heard in Laclede County by Judge Kenneth Michael Hayden. The notice has been forwarded to the judge for review, according to court records.
Berger has a long history of court proceedings with his former employer. In 2013, he won a lawsuit against Emerson and was awarded $30 million by a Laclede County jury. Berger had claimed that while working at the local plant, he was exposed to chemicals that gave him a lung condition.
